These Terms of Use ("Terms") govern your use of the BackChat! mobile application (the "App") developed by RiverSky Labs, the trading name of a sole developer ("I", "me", or "my"). By downloading, installing, or using the App, you agree to be bound by these Terms.
By accessing or using BackChat!, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the App.
BackChat! is a party game in which players listen to reversed audio phrases and attempt to speak them backwards. The App records players' spoken attempts using the device microphone, processes them locally using a custom native module, plays them back in reverse, and allows players to compare their attempts to the original phrase.
The App is available as a free tier (with advertisements) and as a paid subscription tier ("BackChat! Pro") which removes ads and unlocks additional phrase categories.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes on a compatible mobile device that you own or control, subject to these Terms.
This license does not grant you any rights to the App's source code, underlying algorithms, or proprietary audio processing technology.

The App requires the following device permissions for core functionality:
expo-audio and processed locally by the native-audio-processing native module. The microphone is only active when you explicitly initiate recording.MediaStore API. This permission is requested only when you choose to save or share a recording.The App's native audio processing module runs entirely on-device. No audio data is transmitted to external servers. Denying permissions may prevent certain features of the App from functioning.
Audio is recorded only when you explicitly initiate recording during gameplay by pressing and holding the Record button. All recordings are stored locally on your device and are not transmitted to any server. You are responsible for obtaining consent from any individuals whose voices may be recorded during gameplay.
BackChat! offers an optional paid subscription ("BackChat! Pro") that unlocks additional phrase categories and removes advertisements. A one-time lifetime purchase option is also available. Subscriptions and purchases are processed and billed through Google Play (Android) or the Apple App Store (iOS).
Subscription entitlements are managed through RevenueCat, a third-party service. I do not have access to your payment details.
The free tier of BackChat! displays advertisements served by Google AdMob. Ads include banner ads during gameplay and interstitial ads between rounds. BackChat! Pro subscribers do not see any advertisements.
In regions where required by law (such as the UK and European Economic Area), the App presents a consent form before ads are loaded, allowing you to consent to personalised ads, manage your preferences, or decline. If you decline, only limited or non-personalised ads are shown. On iOS, the App also requests permission via the App Tracking Transparency framework. AdMob may collect device-level data as described in Google's Privacy Policy.
The phrase audio content included in the App is generated using ElevenLabs text-to-speech technology and is incorporated under license. This content is the property of RiverSky Labs and/or its licensors.

All third-party content is provided "as is" and subject to the respective licensor's terms. RiverSky Labs makes no representations regarding the accuracy or completeness of third-party generated content.
All content in the App — including but not limited to audio files, graphics, logos, icons, text, user interface design, native modules, and software code — is the property of RiverSky Labs or its licensors and is protected by applicable intellectual property laws.
Audio recordings you create during gameplay are your own content. I do not claim any ownership or rights over your recordings. Since recordings are stored only on your device, you retain full control over them.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. I DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
I do not warrant that the App will be compatible with all devices or operating system versions. The App's native audio processing module requires specific hardware and software capabilities that may not be available on all devices.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RIVERSKY LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
In no event shall the total aggregate liability exceed the greater of the amount you paid for the App or any subscription in the twelve (12) months preceding the claim, or ten pounds sterling (£10), whichever is greater.
If you downloaded the App from the Apple App Store or Google Play Store, you acknowledge and agree that:
I reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason. Upon termination, your license to use the App is immediately revoked. You may terminate your use of the App at any time by uninstalling it from your device. Active subscriptions should be cancelled through Google Play (Android) or Settings > Subscriptions (iOS) before uninstalling.
I may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RiverSky Labs operates, without regard to conflict of law principles.
